About these terms
These terms are an agreement between you and Property Mind App Limited (company number 17395872). “We” and “us” mean Property Mind App Limited. They apply when you use Property Mind on the web or in our apps. By creating an account, you agree to them.
Our privacy policy explains how we handle personal data, and forms part of these terms.
What Property Mind is
Property Mind helps self-managing landlords in England keep track of their properties, tenancies and compliance duties. It helps them store documents, record how notices were served, and handle repairs with their tenants. Tenants can have their own accounts, which their landlord invites them to.
Property Mind is not legal advice
Property Mind tells you what the law appears to require. It does not advise you. The reminders, deadlines and checks in the app come from our reading of the law in England, and of official guidance. Each one shows how certain that reading is: whether it is settled law, best practice, or something expected but not yet in force.
The law changes, and it applies differently depending on your circumstances. Property Mind cannot know everything about your situation. You stay responsible for meeting your obligations as a landlord. If you are unsure, or something important depends on it, get advice from a solicitor or another qualified adviser.
Your account
- You must be 18 or over to have an account.
- Give us accurate details, and keep them up to date.
- Keep your sign-in details private. Tell us straight away if you think someone else has used your account.
- You are responsible for what is done through your account.
What you put in
You own the information and documents you add to Property Mind. You give us permission to store and process them only as far as we need to, to provide the service to you.
You must only add information you are entitled to add. In particular:
- If you are a landlord, you need a lawful reason to add your tenants' details. For a tenancy you manage, you will normally have one.
- Documents you upload must be genuine, and yours to share.
When we process data for landlords
For what a landlord records about their tenancies, the landlord is the controller and we are their processor. For that data, we will:
- process it only to provide Property Mind, and on the landlord's instructions
- make sure everyone who can access it is bound by confidentiality
- keep it secure, and store it in the UK as our privacy policy describes
- use only the providers listed in our privacy policy, under equivalent contract terms, and give notice before adding a new one
- help the landlord respond when someone asks to use their data protection rights, and tell the landlord without undue delay if there is a breach
- delete or return the data when the landlord closes their account, except records we must keep, as the privacy policy explains
- give the landlord the information needed to show we meet these commitments
The evidence record
Property Mind keeps a dated record of what was done, when and by whom. That record can be added to, but not edited or removed, even by us. This is what makes it useful as evidence, and it is why some records are kept after an account is deleted.
Acceptable use
You must not:
- use Property Mind to harass, mislead or intimidate anyone, including tenants
- upload anything unlawful, or anything that infringes someone else's rights
- try to get into accounts or data that are not yours
- disrupt or overload the service, or try to reverse-engineer it
Fees
Property Mind is free while it is in early access. If we introduce paid plans, we will tell you before they apply to you, and you will never be charged unless you agree.
Availability and changes
We work to keep Property Mind available and accurate, but we cannot promise it will always be uninterrupted or free of errors. We may change or improve features. If we plan to remove something you rely on, or to close the service, we will give you reasonable notice and a way to export your records.
Our liability
Nothing in these terms limits our liability where that would be unlawful. That includes liability for death or personal injury caused by our negligence, and for fraud.
Otherwise, we are not responsible for losses that come from relying on Property Mind instead of taking advice, or from the information you put in being wrong. We are also not responsible for losses we could not reasonably have foreseen. If you use Property Mind as a consumer, you keep all your statutory rights.
Ending your account
You can delete your account at any time. See how to delete your account. We may suspend or close an account that breaks these terms, and will tell you why unless the law prevents us.
Law and changes to these terms
These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
If we change these terms, we will update the date at the top. We will tell you before a significant change takes effect.
